In the unlikely event your portrait ends up lost or damaged, I will then undertake the work again, so no risk to you.

Unlimited Revisions:
If the customer feels revisions need making, I will revisit the work until it's right, because if you're not happy neither am I!

No Deposit.

In most circumstances no deposit will be needed, this is for portraits with less than four subjects.

However with more than three subjects, a deposit of 20-30% percent may be asked for. And If you are ordering framing, the price of the frame is taken upfront. No Vat added.

Risk Free.

In the unlikely event the customer is unhappy with the portrait. I will attempt to rectify the problem. Then if no compromise is possible, no further payment will be asked for.

Framing Service.

I also offer a framing service; these top-quality frames are supplied by a renowned gallery supplier. The frames are made bespoke per customer, and all double mounted, backed, sealed and ready to hang.

If there’s an image you want to republish, you MUST get express permission from me before you can legally use it.
    Copyright infringement is serious. If you’re caught, at the very least you will be forced to remove the infringing images from publication. If legal action is taken, you could be subject to a civil lawsuit in the copyright owner’s jurisdiction and actual and statutory damages could be faced.
    I retain the copyright on all artwork I create.
    I also keep the right for displaying any work I create (along with the appropriate photographs) on my web sites or elsewhere. If you strongly object to this, you must make me aware, so I can respect your wishes.
    Conditions
    In the extremely unlikely event that you don’t think the portrait is a true representative of the supplied photograph, I will be happy to re-visit the portrait free of charge, after the revision has been done and you still don’t think it’s right then you are no longer obliged to carry on with the contract and it will be left at that.
    Once you have agreed you are satisfied with the work via email, then the work will be fixed, and I may no longer be able to make alterations to it and once the work has been paid for, there will be no refunds after this point, unless the work has been damaged, lost or stolen in transit, (photo evidence must be provided to me to enable to claim a refund from the courier firm).
    In the extremely unlikely event of this happening then I will book the work back in and redo the work at no extra cost to yourself within 4 weeks.
    Once you have submitted your order and the work has commenced, upon completion and your final approval you are obliged to complete full and final payment in a timely manner, (usually 7 days) from the date of completion, if you have an earliest date portrait can be paid for please put this on the form when filling in.
    Prior to full payment the client may make alterations to the drawing. This work will be done free of charge however if the client wishes to have extra items/subjects or make major alterations which are different to the original discussion notes there will be an extra cost applied, this will be fully agreed by myself and the client before full and final work commences.
    If you have ordered framing with the portrait, you may be asked for an upfront payment for the frame, this is solely so the customer cannot change their mind on the frame after its ordered as these are ordered bespoke per customer, if you have paid for your frame and with the very unlikely event you aren’t happy with the work you will receive a full refund for the frame.
    Other
    Although I appreciate personal circumstances do change I am running a business and would appreciate if you contacted me if you have any problems with payment, so we can work together to provide a solution. Exceptions on payment timescale’s can be made between me and the client to coincide with holidays etc.
    All commissions must be paid for in full before they are dispatched. Methods of payment accepted are cheque, bankers draft, direct bank transfer or Pay Pal.
    To discuss other payment options please contact me. Although I work to a no deposit rule on certain high specification portraits where I may need to purchase bespoke materials such as made to order frames etc. I may ask for a small deposit. This deposit is non-refundable.
    Visitors to my web site can be assured that the protection of privacy and confidentiality are given the highest priority and that all personal information collected is held and used in compliance with the EU Data Protection Act 2018 By providing photos to me in order to commission the work you are giving me consent to using the photo(s) provided by yourself. You are also giving permission for me to use the images of finished work for example purposes on my site and my social media site, unless stated otherwise, there will be no issues in removing the work or not publishing it for any reason.
    Framing service
    If you have requested framing: Framing of the portrait, as frames are ordered from another source, I cannot be sure of the stability of the molding, glazing, hanging brackets, mount or backing board, on the frames, I will not be held responsible for any problems that come with these, however no problems have been reported at present All efforts have been made to make sure all information is correct and up to date on this site or any other sites which I may advertise on, however it is the sole responsibility of the customer if you have any queries to do with your portrait and your rights, to ask for information in any part of this web site, some parts may have changed.
    Changes to the Terms & Conditions
    – I reserve the right to change the Terms & Conditions and post a new version onto my web site. The new version will take effect from the time of posting on the site.
    Advisories
    It’s important that you care for the portrait to try and avoid warping and fading, it is advisable that you keep your drawing/painting out of direct sunlight/heat, damp and humid areas as this could affect the paper and surface over the years, it’s more likely that in these high risk areas the paper will fade or colour first, keeping your portrait out of these areas will help to keep the drawing nice, although with my advice on this, it’s yet to be an issue with any of my customers but the care of the product is down to you once received.

    Data Retention
    Any personal photographs or data that have been uploaded to my website or email server will be kept on file for historical purposes only and deleted within 72 months of the order being completed.
    I will retain other minimal data i.e. copies of invoices for tax, anti-fraud and other purposes for 72 months from completion of the order.

    Images of finished work may be used for example purposes on my website and social media sites and will be kept indefinitely, there are no issues in removing the work or not publishing it for any reason, just email bobby.s@portraitsinpencilbybobby.com please note removal may take up to 5 working days.

    Use of Information
    I may use information held about you in the following ways:
    • To contact you to discuss your enquiry/order.
    • To notify you about changes to the site, goods and/or services.
    • To notify you about special offers or promotions. (you can opt out at any time when/if you receive marketing information. Information such as your name and email address is stored for such purposes).
    • For courier and postal purposes, this may include name, delivery address, email address and telephone number.

    Bobby’s Pencil Portraits does not see or record any online payment transactions, this is handled through PayPal.
    PayPal’s Privacy Policy will explain how they may collect, retain, process, share and transfer your personal data when you visit its site or use its services.

    Bank transfers
    No personal information is recorded using this option as I will supply my necessary details to the customer in order for the customer to complete the payment.

    Cheque payments
    All payments made by cheque are forwarded securely onto the bank or post office of my choice, no records or copies of cheques are held physically or electronically.

    I reserve the right, at my discretion, to change, modify, add, or remove portions from this policy at any time. Your continued use of our site following the posting of any changes to this policy means you accept such changes.
