Copyright: All images on this web site are copyrighted to Mr Robert Shirt unless agreed otherwise, if you use images obtained from this web site to create logo’s, promotional material or for use on your own web site, you could be guilty of copyright infringement. If there’s an image you want to republish, you MUST get express permission from me before you can legally use it.

Copyright infringement is serious. If you’re caught, at the very least you will be forced to remove the infringing images from publication. If legal action is taken, you could be subject to a civil lawsuit in the copyright owner’s jurisdiction and actual and statutory damages could be faced.
I retain the copyright on all artwork I create.

I also keep the right for displaying any work I create (along with the appropriate photographs) on my web sites or elsewhere. If you strongly object to this, you must make me aware, so I can respect your wishes.

Conditions

In the extremely unlikely event that you don’t think the portrait is a true representative of the supplied photograph, I will be happy to re-visit the portrait free of charge, after the revision has been done and you still don’t think it’s right then you are no longer obliged to carry on with the contract and it will be left at that.

Once you have agreed you are satisfied with the work via email, then the work will be fixed, and I may no longer be able to make alterations to it and once the work has been paid for, there will be no refunds after this point, unless the work has been damaged, lost or stolen in transit, (photo evidence must be provided to me to enable to claim a refund from the courier firm).
In the extremely unlikely event of this happening then I will book the work back in and redo the work at no extra cost to yourself within 4 weeks.

Once you have submitted your order and the work has commenced, upon completion and your final approval you are obliged to complete full and final payment in a timely manner, (usually 7 days) from the date of completion, if you have an earliest date portrait can be paid for, please put this on the form when filling in.

Prior to full payment the client may make alterations to the drawing. This work will be done free of charge however if the client wishes to have extra items/subjects or make major alterations which are different to the original discussion notes there will be an extra cost applied, this will be fully agreed by myself and the client before full and final work commences.

If you have ordered framing with the portrait, you may be asked for an upfront payment for the frame, this is solely so the customer cannot change their mind on the frame after its ordered as these are ordered bespoke per customer, if you have paid for your frame and with the very unlikely event you aren’t happy with the work to this point, you will receive a full refund for the frame.

All possible efforts have been made to make sure all information is correct and up to date on this site or any other sites which I may advertise on, however it is the sole responsibility of the customer if you have any queries or concerns to do with your portrait, quality, and rights, to ask for information in any part of this web site.
Some information or products may have changed or been removed.

Other

Although I appreciate personal circumstances do change I am running a business and would appreciate if you contacted me if you have any problems with payment, so we can work together to provide a solution. Exceptions on payment timescale’s can be made between me and the client to coincide with holidays etc.

All commissions must be paid for in full before they are dispatched. Methods of payment accepted are cheque, bankers draft, direct bank transfer or Pay Pal.

To discuss other payment options please contact me. Although I work to a no deposit rule on certain high specification portraits where I may need to purchase bespoke materials such as made to order frames etc. I may ask for a small deposit. This deposit is non-refundable.

Visitors to my web site can be assured that the protection of privacy and confidentiality are given the highest priority and that all personal information collected is held and used in compliance with the EU Data Protection Act 2018 By providing photos to me in order to commission the work you are giving me consent to using the photo(s) provided by yourself. You are also giving permission for me to use the images of finished work for example purposes on my site and my social media site, unless stated otherwise, there will be no issues in removing the work or not publishing it for any reason.

Reporting any problems with the work once delivered must be done so within 14 days of receiving. No refunds are given past this point.

PayPal pay 3

PayPal Pay in 3 is an interest-free loan that lets you split your basket into 3 payments, with the first due at time of purchase and subsequent payments due every month on the same date. It’s a great way to spread the cost of larger items or to cover emergencies and is a helpful tool to manage your budget more effectively. Please note that pay in 3 is a form of credit, so carefully consider whether you can afford the repayments and possible impact to your credit score.

I will not be held responsible for any financial difficulties that may arise from late payments.

It is the sole responsibility of yourself to make sure you can keep up with the payments, the pay in 3 contract is between yourself and PayPal I will not be held responsible for any financial difficulties that may arise from late or missed payments, know your facts before accepting the contract of credit with them.

Framing service / Backing / Paper

If you have requested framing: Framing of the portrait, as frames are ordered from another source, I cannot be sure of the stability of the moulding, glazing, hanging brackets, mount or backing board, on the frames, I will not be held responsible for any problems that arise from the use of these products, or any product used in the process. Mount boards are acid free.

All art surfaces used for painting and drawing are acid free.

No problems have been reported at present.

Postage

You will have 7 days to report and damaged goods, if it arrives damaged the work will be done again and no refunds given.

You must allow at least 30 days for the portrait to arrive via post, after that I will redo the work for you.

I cannot guarantee the parcel will arrive for the date you requested; no refunds will be given for this reason.

Changes to the Terms & Conditions

– I reserve the right to change the Terms & Conditions and post a new version onto my web site. The new version will take effect from the time of posting on the site.

Advisories

For longevity. It’s important that you care for the portrait to try and avoid warping and fading, it is advisable that you keep your drawing/painting out of direct sunlight/heat, damp and humid areas as this could affect the paper and surface over the years, it’s more likely that in these high-risk areas the paper will fade or colour first. For unframed portraits, it's advisable you take to your local framer.

Keeping your portrait out of these areas will help the drawing/artwork and give a longer life.

The care of the product is down to you once received.
